By accessing Path ("we," "us," or "our") at pathmarketingagency.com or through any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
2. Eligibility
You may use Path only if you have the legal power to form a contract with us and are not barred from doing so under applicable laws. By using the Service, you represent that you meet any applicable age requirements and are not restricted from accessing such services under the laws of your jurisdiction.
3. Accounts
You are responsible for all activity on your account. You must provide accurate information (e.g., your email address) and safeguard your login credentials. If you sign up via Google OAuth, you acknowledge that password storage and authentication are handled by Google. Please notify us immediately of any unauthorized access or security breach. You may delete your account data at any time in your account settings.
4. Usage of Path
Acceptable Use. You may not use the Service for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction, engage in harmful or fraudulent activities, or disrupt the experience of other users.
AI-Generated Content. Path uses artificial intelligence to generate marketing recommendations, experiment ideas, and strategic advice ("AI Content"). We continuously work to provide the most accurate and helpful recommendations possible based on the information you provide and our extensive marketing knowledge base. However, you should be aware that large language model (LLM) technology, while powerful, has inherent characteristics of unpredictability and may occasionally produce unexpected results despite our best efforts to ensure quality.
Your Responsibility for AI Content. While we believe strongly in our technology and strive to deliver valuable insights, AI-generated recommendations should be evaluated in the context of your specific business situation. You acknowledge that you are responsible for reviewing, evaluating, and deciding whether to implement any marketing strategies suggested by Path. We recommend using our recommendations as a starting point and applying your own business judgment, particularly for significant marketing investments.
5. User Content
You retain ownership of any business information, questionnaire responses, and experiment data you submit. You grant us a worldwide, non-exclusive license to process, analyze, and display this information as needed to provide Path's services. We will not share your business information with other users or third parties except as described in our Privacy Policy.
6. Payment and Billing
Path is offered as a monthly subscription service at $29 per month. All payments are processed through Stripe. You can cancel your subscription at any time through your account settings or Stripe's billing portal. Cancellations take effect at the end of your current billing period. We do not offer refunds for partial months.
7. Intellectual Property
The Path name, logo, brand marks, and all related intellectual property belong solely to Path. The recommendation algorithms, channel scoring system, and experiment framework are our proprietary technology. You may not use or modify our trademarks or copy our systems without written consent.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available." We disclaim all warranties, whether express or implied, including merchantability and fitness for a particular purpose. We do not guarantee that our marketing recommendations will produce specific results or that the AI outputs will meet your requirements or be error-free.
9. Limitation of Liability
To the fullest extent permitted by law, Path is not liable for indirect, special, incidental, consequential, or punitive damages. This includes loss of data, profits, or revenues arising from your use of the Service or implementation of our recommendations. Our total liability is limited to the amount you paid us in the past month for the Service.
10. Termination
We reserve the right to suspend or terminate your access if you breach these Terms. Upon termination, you lose access to your account, any stored project data, experiments, and recommendations. We will not be liable to you or any third party for the termination of your account in accordance with these Terms.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware (USA), without regard to conflict of laws principles. You agree to resolve any dispute arising out of or related to these Terms through binding arbitration in accordance with applicable rules, unless otherwise required by law.
12. Changes to These Terms
We may update these Terms from time to time, and we will notify you of significant changes via email or by posting a notice on our website. Your continued use of Path after such changes take effect constitutes your acceptance of the revised Terms.
